What happens to it? Do we have to sell it? Where do we even start?
Here’s a simple way to think about it:
What is probate? Probate is the legal process of settling someone’s estate. If the home wasn’t placed in a trust or set up to transfer automatically, it will likely go through this process to ensure everything is handled correctly.
What happens first? A personal representative (executor) is appointed, and from there:
Filing a probate case
Identifying and valuing assets (including the home)
Notifying creditors
Determining next steps for the real estate
What happens to the house? This is usually the biggest question, and the answer varies with each individual situation.
The good news is, you can begin preparing for the next step while everything is being finalized. While the legal process is unfolding, you can still:

Evaluate its condition
