What Happens to a Home During Probate? A Simple Guide for Families

There are moments in life where everything feels heavy. Losing a loved one is one of those moments. And often, in the middle of grief, paperwork, and family conversations… there’s a house.

What happens to it? Do we have to sell it? Where do we even start?

Here’s a simple way to think about it:

What is probate? Probate is the legal process of settling someone’s estate. If the home wasn’t placed in a trust or set up to transfer automatically, it will likely go through this process to ensure everything is handled correctly.

What happens first? A personal representative (executor) is appointed, and from there:

  • Filing a probate case

  • Identifying and valuing assets (including the home)

  • Notifying creditors

  • Determining next steps for the real estate

What happens to the house? This is usually the biggest question, and the answer varies with each individual situation.

The good news is, you can begin preparing for the next step while everything is being finalized. While the legal process is unfolding, you can still:

  • Clean out the home

  • Evaluate its condition

  • Explore potential sale strategies

Common mistakes I see:

  • Waiting too long for guidance

  • Letting the home sit without a plan

  • Over-improving or maybe not improving at all

None of these come from a bad place, simply uncertainty during a difficult time.

What actually helps: Having a plan and the right people in your corner. Such as:

  • A trusted estate attorney

  • Creating a clear timeline

  • Coordinating clean-out or donation resources

  • Deciding whether to sell as-is or make updates

  • Positioning the home properly when (and if) it hits the market

Every situation is different, but creating a strategy in the early stages can be a game changer.
